Terms of Service

1. Acceptance of Terms
By creating an account, starting a free trial, or using any part of OD (Ona Digital), you agree to these Terms of Service. If you do not agree, do not use the service.
You must be at least 18 years old to create an account. By using OD you confirm that you meet this requirement and that any information you provide is accurate.
2. Description of Service
OD is a software platform for starting and running a digital marketing agency. It includes prospecting tools, a lead pipeline and CRM, proposals and contracts, client management, a content calendar, AI content tools, invoicing, time and expense tracking, analytics, and educational material.
OD is a software tool, not a guarantee of income. Results depend entirely on your own effort, skill, market and execution. Nothing in the platform, the Academy, or our marketing constitutes a promise of any specific revenue outcome.
We may add, change, or remove features at any time as the product evolves.
3. Subscription and Billing
OD is sold as a recurring subscription on monthly or annual terms. Current plans are Starter, Growth, and Agency Pro at the prices shown on the pricing page.
Payments are processed by Stripe. By subscribing you authorize us, through Stripe, to charge your payment method on a recurring basis until you cancel.
Subscriptions renew automatically at the end of each billing period at the then-current price for your plan. We will give notice before any price change affecting your renewal.
Applicable taxes may be added at checkout based on your location.
4. Free Trial
New accounts may start a free trial as described at checkout. Your payment method is collected when the trial begins.
Unless you cancel before the trial ends, your subscription starts automatically at the end of the trial period and your payment method is charged the full plan price.
You may cancel at any point during the trial from Settings → Billing and you will not be charged.
Trials are limited to one per customer. Creating multiple accounts to extend a trial is a breach of these terms.
5. Refund Policy
We offer a full refund on your first paid charge if you request it within 7 days of that charge. Email support@onadigital.org from the address on your account.
Renewal charges after the first billing period are non-refundable, though you can cancel at any time to stop future charges.
Refunds are returned to the original payment method and typically appear within 5–10 business days.
6. Cancellation
You can cancel at any time from Settings → Billing. There are no cancellation fees and no long-term commitments on monthly plans.
When you cancel, your subscription remains active until the end of the period you have already paid for. After that, access to paid features ends.
We do not delete your data immediately on cancellation. You may request export or deletion of your data at any time by emailing support@onadigital.org.
7. User Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree not to: use OD for unlawful purposes; send spam or unsolicited messages in violation of applicable law (including CAN-SPAM, CASL and GDPR); scrape, resell, or redistribute the platform or its content; reverse engineer the service; or upload malicious code.
You are solely responsible for the content you create, send, or publish using OD, including AI-assisted output, and for compliance with the terms of any third-party platform you connect.
You are responsible for your own relationships and contracts with your clients. OD is not a party to them.
8. Intellectual Property
The OD platform, brand, source code, templates, scripts, SOPs, and Academy material are owned by Ona Digital and protected by intellectual property law.
You receive a limited, non-exclusive, non-transferable licence to use the platform and to use its templates and scripts in your own agency business while your subscription is active.
You may not resell, republish, or distribute OD templates, curriculum, or software as your own product.
You retain ownership of the data and content you put into OD, including your client records and the content you generate.
9. Third-Party Services
OD integrates with third-party services such as Stripe, Google, Meta, and others. Your use of those services is governed by their own terms, and we are not responsible for their availability, accuracy, or actions.
AI features are powered by third-party models. AI output can be inaccurate and must be reviewed by you before it is used with clients.
10. Limitation of Liability
OD is provided "as is" and "as available" without warranties of any kind, express or implied.
To the maximum extent permitted by law, Ona Digital is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or lost business opportunities arising from your use of the service.
Our total aggregate liability for any claim relating to the service is limited to the amount you paid us in the 12 months preceding the claim.
11. Suspension and Termination
We may suspend or terminate an account that breaches these terms, abuses the service, or creates risk or legal exposure for us or other users.
Where practical we will give notice and an opportunity to correct the issue first.
12. Changes to These Terms
We may update these terms as the product and legal requirements change. The "last updated" date at the top of this page always reflects the current version.
Material changes will be communicated by email or in-app notice before they take effect. Continuing to use OD after a change takes effect means you accept the updated terms.
13. Governing Law
These terms are governed by the laws of the United States and the state in which Ona Digital is established, without regard to conflict-of-law rules.
